User Agreement (Terms of Service)

1. General Provisions

These Terms of Service (the “Terms”) are an agreement between you (“You”) and the ParkU developer (“We”). By accessing or using the ParkU application (the “Application”), You agree to be bound by these Terms.

2. License

We grant You a limited, revocable, non-exclusive, non-transferable license to use the Application for personal, non-commercial purposes, subject to these Terms.

3. Eligibility

You represent that You are of legal age to form a binding contract under the laws of your jurisdiction and are not barred from using the Application under applicable law.

4. User Obligations

You agree to: (a) provide accurate information; (b) comply with applicable laws; (c) not upload malware or attempt to disrupt the Application; (d) not engage in fraud, harassment, or abuse of the service or other users.

5. Prohibited Conduct

Prohibited actions include: (a) submitting knowingly false or misleading data; (b) automated mass submissions or bot attacks; (c) interfering with servers, APIs, or security measures; (d) attempting to reverse engineer or scrape protected areas; (e) posting content that violates intellectual property or privacy rights.

6. Crowdsourced Data Disclaimer

The Application relies on user-generated, crowdsourced data that may be incomplete, outdated, or inaccurate. We make no warranties regarding accuracy, reliability, or availability of such data. Use of the Application is at your own risk.

7. Subscription, Payment, and Auto-Renewal

ParkU offers a free tier and an optional Premium subscription priced at USD $2.99 per month (or local equivalent). Premium features include slot booking, push notifications for booked slots, and the ability to create rental listings. The subscription is billed and managed through the Apple App Store or Google Play, depending on your device. By subscribing You agree that:

(a) Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.

(b) The subscription automatically renews each month unless auto-renew is turned off at least 24 hours before the end of the current period.

(c) Your account will be charged for renewal within 24 hours prior to the end of the current period at the price stated above (or any updated price that has been disclosed and accepted).

(d) You may manage or cancel the subscription, or turn off auto-renewal, at any time through your Apple ID account settings (Settings → Apple ID → Subscriptions) or Google Play account (Play Store → Profile → Payments & Subscriptions).

(e) Refunds are governed by the policies of Apple and Google. ParkU does not issue separate refunds.

8. Rental Listings

The Application provides a bulletin-board feature allowing Premium users to list parking spots for rent. ParkU acts solely as an information platform and does not process payments, mediate transactions, or guarantee the accuracy of listings. Users must arrange payment and terms directly between themselves. ParkU is not responsible for any disputes, losses, or damages arising from rental arrangements.

9. Driving Safety

The Application is intended for use only when the vehicle is stationary. You must not interact with the Application while driving or operating a vehicle. Always ensure your vehicle is safely parked before using any features. ParkU assumes no liability for accidents, injuries, or damages resulting from use of the Application while driving.

10. Termination and Suspension

We may suspend or terminate your access to the Application if You violate these Terms or if required by law or operational necessity. You may stop using the Application at any time, and may delete your account from Profile → Delete account.

11. Changes to the Application

We may modify or discontinue all or part of the Application at any time, with or without notice, including due to technical, legal, or business reasons.

12. Force Majeure

We are not liable for delays, failures, or service interruptions caused by events beyond our reasonable control, including war, natural disasters, epidemics, power or internet outages, datacenter failures, or outages of payment providers and third-party platforms.

13. Disclaimer of Warranties

The Application is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of data, revenue, or profit, arising out of or related to your use of the Application.

15. Indemnification

You agree to indemnify and hold harmless the Developer from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the Application.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed under the laws of the United States. Any dispute shall be resolved by binding arbitration under U.S. law, unless otherwise required by mandatory legal provisions.

17. Severability and Waiver

If any provision is found invalid, the remaining provisions remain in full force. Failure to enforce a provision is not a waiver.
