Privacy Policy

1. Introduction

ParkU (“we,” “our,” “us”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information in accordance with applicable U.S. law, the EU General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and the requirements of the Apple App Store and Google Play. ParkU is designed for use only while your vehicle is parked; do not interact with the Application while driving.

2. Data We Collect

(a) Account Data: email, username, language preferences.

(b) Geolocation Data: collected only with your consent and only while actively using Application features that require location.

(c) User Content: parking marks, descriptions, comments, and related metadata.

(d) Technical Data: IP address, device type, OS version, app version, analytics, and crash logs.

(e) Transaction Data: payment tokens and metadata necessary to process subscriptions or purchases.

(f) Push Notification Tokens: device tokens for Firebase Cloud Messaging (FCM) and Apple Push Notification Service (APNs), used solely to deliver push notifications.

(g) Rental Listing Data: parking spot location, title, description, price, and contact information you provide when creating rental listings.

3. Legal Basis for Processing

We process personal data on the following bases:

(a) performance of a contract (to provide Application services);

(b) consent (e.g., geolocation, marketing communications);

(c) legitimate interests (improving the Application, combating fraud and abuse, ensuring security);

(d) compliance with legal obligations.

4. How We Use Data

We use data to:

(a) operate and improve the Application;

(b) personalize user experience (e.g., language and region);

(c) support moderation and abuse prevention;

(d) process payments and manage subscriptions;

(e) comply with legal and regulatory requirements;

(f) communicate with you regarding service updates and important notices;

(g) deliver push notifications about parking events, slot reminders, and booking updates.

5. Data Storage and Location

We store data on Supabase servers located in the United States and/or the European Union. Supabase provides security controls and GDPR-aligned practices. We retain personal data as long as your account is active or necessary to fulfill the purposes outlined herein, unless a longer retention period is required by law.

6. Sharing and Disclosure

We may share data with:

(a) Supabase (hosting, storage, and processing);

(b) Apple Pay and Google Pay, including subscription billing through the Apple App Store and Google Play;

(c) analytics and crash reporting providers, limited to operational needs;

(d) Expo Push Notification service (push delivery);

(e) governmental authorities and law enforcement when required by law.

We do not sell personal data and do not share it for cross-context behavioral advertising.

7. International Data Transfers

Where data is transferred outside your country, we implement appropriate safeguards, including Standard Contractual Clauses (SCC), to protect personal data.

8. Your Rights

Subject to applicable law, you may have rights to access, correct, delete, or port your data, to object or restrict certain processing, and to withdraw consent. You may exercise these rights by contacting support@parku.autos. You also have the right to lodge a complaint with a supervisory authority.

9. Account Deletion

You may delete your ParkU account at any time directly from the Application: Profile → Delete account. Deletion removes your account data, your contributed parking marks, your rental listings, push tokens, and related metadata, subject to any retention required by law. You may also request deletion by writing to support@parku.autos.

10. CCPA Rights (California Residents)

If you are a California resident, you have the right to: (a) know what personal information we collect, use, disclose, and sell; (b) delete personal information we have collected; (c) opt out of the sale or sharing of personal information; (d) limit the use of sensitive personal information; (e) non-discrimination for exercising your privacy rights — we will not deny services, charge different prices, or provide a different quality of service because you exercised these rights. We do not sell personal information.

11. Security Measures

We protect data in transit using HTTPS/TLS, apply access controls, and follow industry best practices to reduce risks of unauthorized access, disclosure, alteration, or destruction.

12. Data Breach Notification

In the event of a personal data breach likely to result in a risk to your rights and freedoms, we will notify the competent supervisory authority without undue delay and, where feasible, within 72 hours of becoming aware of the breach, and notify affected users where required by applicable law.

13. Children’s Privacy

The Application is not intended for children under 13 (or under the minimum legal age in your jurisdiction; in the European Economic Area this is generally 16 unless lower under applicable member-state law). If we learn that we have collected personal data from a child without verifiable parental consent, we will delete it.

14. Cookies and Local Storage

The website at parku.autos uses only essential browser local storage to remember your language preference. We do not use tracking, advertising, or third-party analytics cookies on the website. The mobile Application uses standard mobile platform identifiers required for its operation and does not use web cookies.

15. Force Majeure

We are not responsible for any failure to perform or any delay due to causes beyond our reasonable control, including natural disasters, cyberattacks, internet or power outages, war, or government actions.

16. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated within the Application. Continued use constitutes acceptance of the updated Policy. The “Effective date” at the top of this Policy reflects the date of the most recent revision.
